ElderTrace offers a monthly subscription service that provides software as a service (SaaS). Our platform aims to assist in locating your loved ones using our services. By subscribing to our Premium Guardian service, you agree to pay a recurring monthly fee.
Our subscription service operates without fixed-term contracts. You may cancel your subscription at any time without incurring cancellation fees, subject to our cancellation policy.
5.1 Monthly Payments: Your subscription fee will be charged monthly on the date you first subscribed.
5.2 Cancellation: You may cancel your subscription at any time through your personal profile on our website.
5.3 Refunds: If you cancel your subscription after a monthly payment has been taken, no refund will be made for that month. However, you will continue to have access to our services until the end of that billing cycle.
6.1 We are committed to protecting your personal data and complying with the GDPR and the Data Protection Act 2018.
6.2 We act as a data controller for the personal information you provide to us. Our legal basis for processing your data is the performance of our contract with you and, where relevant, your consent.
6.3 We only share your information with Stripe, our payment services provider, to facilitate payments. We share only what is necessary to fulfil that purpose.

Lost or damaged bands when subscribed to our Premium Guardian Plan are replaced free. This is limited to 2 per year. Any further replacements will be charged at £3.
8.1 Nothing in these terms shall limit or exclude our liability for death or personal injury resulting from our negligence, fraud, or fraudulent misrepresentation.
8.2 Subject to clause 8.1, ElderTrace shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Service.
8.3 Our total liability to you in respect of all other losses shall not exceed the amount paid by you for the Service in the 12 months preceding the date of the claim.
ElderTrace reserves the right to terminate the subscription or account of any person deemed to be misusing the Service or in breach of these terms.
The Service is intended for use by persons residing in the United Kingdom. We do not warrant that the Service is appropriate or available for use in other locations.
We may revise these terms from time to time. The revised terms shall apply from the date of publication on our website. Please check this page regularly to ensure you understand the terms that apply at the time.
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
